FIFTY FIFTY’s Side Reveals Stance Following Appeal Dismissal, “Considering Whether To Proceed With Main Lawsuit”

On October 25th, Barun Law, the legal representative of three FIFTY FIFTY members Saena, Sio, and Aran, revealed their position regarding the court’s dismissal of their appeal via OSEN, saying “The decision was made when our submission of the explanatory statement was postponed due to various reasons, such as the change of justice department and the agency’s notice of contract termination, during the process of preparing content for the appeal trial, including the reason for the appeal”.

They continued, “Based on the existing content and decision of the first trial without the explanatory statement for the reason of the appeal, this decision should be judged similar to the decision that said, ‘The issues related to the settlement structure for the import of music records, the unreported details and items of the prepayment made by the music distributor for the production of FIFTY FIFTY, and the question of whether the CEO was involved in embezzlement should be determined through a thorough trial and evidence examination in the main lawsuit’”.

Regarding their plan for the dispute with Attrakt in the future, the legal representative stated, “Since both parties have notified the termination of the exclusive contracts, it is judged that the contracts have been terminated for the time being”, adding “Accordingly, we are discussing and considering whether to proceed with the main lawsuit”.

Earlier on October 24th, the Seoul High Court’s Civil Affairs Department 25-2 rejected the appeal filed by three FIFTY FIFTY members against the court’s decision to turn down their application for an injunction to suspend contracts with Attrakt. Accordingly the reports, the court dismissed the appeal because FIFTY FIFTY’s side did not submit their reason explanatory statement for the appeal. 

FIFTY FIFTY immediately appealed right after their injunction application was rejected in August. However, member Keena appointed a new legal representative on October 16th, withdrew the appeal, and returned to Attrakt. The remaining members of FIFTY FIFTY continued their dispute with Attrakt.

On the 19th, Attrakt announced the termination of exclusive contracts with Saena, Sio and Aran.
