Lee Sun-kyun and G-Dragon’s Negative Drug Test Results: Police Face Challenges, Public Left with Questions

The police are facing difficulties in proving the drug use allegations against G-Dragon and Lee Sun-kyun 

The Incheon Police Narcotics Crime Investigation Division conducted two rounds of investigations into G-Dragon and Lee Sun-kyun separately as suspects under the drug control law. As top stars in their respective fields, the investigation attracted public attention, and criticism began even before the allegations were proven. 

However, both G-Dragon and Lee Sun-kyun received ‘negative’ results in detailed and preliminary drug tests, leading to divided public opinions. Some argue that the police investigation may have yielded questionable results.

In G-Dragon’s case, the situation became complicated as the police had only secured statements from the informant and the manager of an entertainment establishment, a 29-year-old woman identified as A. Despite persistent denial of the allegations since they first emerged last month, G-Dragon, after completing his first police questioning on November 6th, responded to reporters’ inquiries about the evidence by saying, “Do you think there is evidence the police presented? No, there isn’t.”

Furthermore, G-Dragon displayed jokes and actions, leading to concerns that the police may have rushed into the investigation without clear evidence, only to be ridiculed by the suspect. 

On November 10th, G-Dragon directly refuted the police’s claim that he shaved his body hair to destroy evidence, stating, “The police’s claim that I shaved my entire body to hide the allegations is clearly false.”

The police’s ability to prove the allegations will likely determine the direction of further investigations into both Lee Sun-kyun and G-Dragon. The crucial factor is the detailed forensic results from the National Forensic Service for G-Dragon and Lee Sun-kyun. 

In the initial police investigation, G-Dragon provided hair and nail samples, which were sent to the National Forensic Service for precise analysis on November 7th.

If G-Dragon, like Lee Sun-kyun, receives a negative result from the National Forensic Service, proving the allegations may become more challenging. The police plan to reinforce the investigation based on the results from the National Forensic Service before summoning G-Dragon again.

There is a high possibility that the police will make efforts to obtain G-Dragon’s phone records to secure evidence of calls. Earlier, it was reported that the police had acquired various evidence by conducting digital forensics on Lee Sun-kyun’s phone. 

However, in G-Dragon’s case, the police’s request for a warrant to check his communication records was already rejected once by the court, citing a lack of clear evidence for the criminal allegations.

In the case of Lee Sun-kyun, who showed no drug-related substances in both preliminary and detailed tests, the police have secured his leg hair for another detailed examination by the National Forensic Service. It is known that drug substances remain in leg hair longer than in regular hair.

During police questioning, Lee Sun-kyun admitted to the fact of drug ingestion but stated that he did not know what exactly the manager of the entertainment establishment gave him. If there was no intentional drug use, it would be difficult to prosecute him since criminal acts without intent are not punishable under the law.

In the legal community, the prevailing opinion is that the police should prioritize securing objective evidence. Prosecution and maintaining charges solely based on circumstantial evidence are challenging. 

A legal expert said, “The background behind G-Dragon’s criminal investigation is revealed to be the manager’s statement from the entertainment establishment. Currently, it appears that the evidence for the police to prosecute is insufficient. If the drug test results continue to be negative, and there is no evidence other than the statements of the parties involved, prosecution will be challenging.”

Another legal expert emphasized the importance of gathering additional evidence, “There is a high probability that statements made during the investigation may be reversed in later prosecution and trial proceedings. Presenting the positive results from the National Forensic Service as substantial evidence and securing other evidence, such as the timing and frequency of drug use through digital forensics, is important.”
