Court rejects application for injunction to ban broadcasting “In the Name of God”

The application for an injunction to ban broadcasting “In the Name of God: A Holy Betrayal” (hereinafter referred to as “In the Name of God”) filed by Baby Garden was rejected.

On May 24th, the 50th Civil Division of the Seoul Central District Court rejected the application for an injunction to ban broadcasting Netflix’s “In the Name of God” and decided that Baby Garden and Kim Ki Soon should bear the costs of the lawsuit.

The court saw that the production company MBC and PD Cho Sung Hyun did not have the rights to “In the Name of God”.

The court added, “Even if they have the video, it’s difficult to say that there’s a risk of additional personal rights infringement on Baby Garden and Kim Ki Soon.”

Last March, Baby Garden and Kim Ki Soon sued MBC, PD Cho Sung Hyun, who directed “In the Name of God”, and the OTT platform Netflix Korea, saying that episodes 5 and 6 of “In the Name of God” contain false information.

However, Baby Garden and Kim Ki Soon withdrew the injunction against Netflix Korea, and they have only been proceeding with lawsuits against MBC and PD Cho Sung Hyun.

They also filed an injunction against Netflix’s U.S. headquarters, but withdrew it on May 16th.
