TWICE Nayeon wins the lawsuit of 600-million-won debts, “Lack of evidence”

The ex-lover of Nayeon’s mother filed a lawsuit to claim the money he lent Nayeon and her mother but lost

According to legal circles on September 19th, the Civil Division 13 of Seoul Eastern District Court ruled in favor of Nayeon and her mother in the loan lawsuit filed by A.

The court acknowledged that A had transferred over 500 million to Nayeon and her mother over the period of 12 years but judged that there was not enough evidence to consider it a loan.

According to the court’s ruling, A transferred a total of 535,908,275 won to Nayeon for 12 years from August 2004 to June 2016. In addition, Nayeon and her mother were found to have made payments of 115,612,093 won with a credit card under A’s name for six years from March 2009 to February 2015. Nayeon debuted as a member of TWICE in October 2015.

A filed a lawsuit against Nayeon and Nayeon’s mother in January last year. At the trial, A claimed, “At the request of Nayeon’s mother, I lent her the money to cover living expenses. Nayeon, who was a trainee at that time, promised that she would pay back the money after she debuted as a singer, but Nayeon broke her promise”. Two acquaintances of A who appeared in the court as witnesses released statements in favor of A, saying “A told us about that several times. He said, ‘If Nayeon made her debut, she would pay back the money A lent them as she promised’”.

However, the court turned down A’s arguments, saying “Considering the frequency, period, amount, and circumstances of the transactions, it is difficult to determine that A and Nayeon had an agreement to return the money”. 

The judge continued, “Considering the fact that A and Nayeon’s mother were in a romantic relationship at that time, it could not be considered a loan. It can be seen that the money was spent on lying expenses considering the payments of monthly rent, telecommunications, loán, and tuition”.

In addition, the judge pointed out, “A claimed ‘expectations’ for Nayeon to return the money after making her debut so it was difficult to consider all the payments as loans. Witnesses also made their statements after knowing the situation through A, not hearing from Nayeon’s side”

Reviewing the lawsuit, lawyer Hwang Sung Hyun said, “A seems to have lent the money with a hope for Nayeon’s success. However, he failed to prove Nayeon’s promise to pay back after her debut with objective evidence. That’s why he lost the case”.

In a telephone interview with Herald Business, Nayeon’s agency JYP Entertainment said they would not release any position on the ruling.

At the moment, the ruling has been confirmed and A did not appeal for the first trial’s ruling.
