Spire Entertainment refuted OMEGA X’s position, “As a result of our confirmation, the claim of CEO Kang’s sexual assault is not true at all”
Spire Entertainment refuted the allegation of former CEO Kang sexually assaulting OMEGA X members.
On the afternoon of December 7th, the Soul Eastern District Court’s Civil Affairs Division 21 held the first questioning in the lawsuit for the suspension of OMEGA X’s exclusive contract validity.
All members of OMEGA X appeared in court with their legal representatives. Many fans also gathered early at the scene to cheer for the members.
OMEGA X’s application for an injunction to suspend the validity of their exclusive contract was received on November 16th. On the same day, the boy group also held a press conference and confessed that they suffered abusive remarks, assault, as well as sexual assault by former CEO Kang.
In addition to the lawsuit for contract termination against the agency, OMEGA X also filed an injunction against CEO Kang and Hwang, Kang’s husband and Spire Entertainment’s Chairman, for criminal charges and alimony claims.
OMEGA X members’ legal representatives said, “The reason for the exclusive contract termination is that the debtor (Spire Entertainment) has violated the personal rights of the creditor (OMEGA X). We can submit the full recording file on August 12th. The members also suffered greater damage before that. Although member Kim Jae Han reported the issues related to CEO Kang and asked for a correction, the violation of personal rights and privacy continued to become severe enough to be considered an assault. Therefore, we believe that a suspension of exclusive contract validity should be made as soon as possible”.
In response, Spire Entertainment’s legal representative denied the claims presented by OMEGA X members, saying “As a result of our confirmation, the sexual assault claim is not true at all”.
The official also added, “From the perspective of the agency, I feel sorry for this situation (abusive language, assault, etc.), and I think the members of OMEGA X must have had a hard time. The agency is also sorry and we think we should do better.”
In addition, they said, “I understand that the relationship between OMEGA X members and CEO Kang was not like this. Because the members called ‘Mom’ and said ‘I love you’ a lot, I didn’t think that CEO Kang made such serious remarks every once in a while. Regardless of her intention, we cannot justify such behavior and took corrective actions. Now that misunderstanding has been resolved and action has been taken, we sincerely hope that the members can trust the agency one more time and change their mind.”
When the court inquired about the schedule of criminal charges for sexual harassment. The members’ legal representatives said, “We plan to file a complaint after the expiration of the injunction to suspend the exclusive contract. We plan to focus on this matter and add more.”
The conflict between OMEGA X and the agency began with a witness story posted by a netizen on an online community after the group’s U.S tour ended last October.
The netizen claimed to have seen OMEGA X, who finished their tour in the U.S., being verbally abused and assaulted by a woman who seemed to be the representative of the agency in front of a hotel. Recordings and videos of the situation at the time were released, and rumors of conflicts between the representative and the members were raised.
The members, who did not reveal their position at the airport, admitted their disagreement with the agency by opening a new SNS account on November 6th, instead of using their previous SNS, which is assumed to be managed by their agency.
A day after the members’ claims, the agency apologized through OMEGA X’s official fan cafe, saying, “The CEO who caused the unfortunate incident voluntarily resigned.” However, the conflict was not resolved.
